By purchasing products from Milcrest Estate or using this website the Customer (purchaser) agrees to the following terms and conditions of sale. Milcrest Estate is proud to be associated with PAYPAL New Zealand’s largest and most preferred payment gateway provider. Milcrest Estate do not collect or store any credit card information. This information is all processed by PAYPAL. When making a purchase you will be directed to a secure webpage hosted by PAYPAL to enter your payment details. The PAYPAL hosted payments page is secured using SSL (Secure Sockets Layer). SSL is a method of ensuring that information submitted through our website is secure and cannot be accessed by unauthorised users. When a website offers an SSL-secured form, the information submitted via that form (typically credit card information) is encrypted using a special certificate key and then decrypted with another key after it has been transmitted. When you access a website secured with SSL using your browser, a symbol displays in your browser windows indicating the site is secure. All prices shown are in New Zealand Dollars. We do not accept and other currency. Your credit card issuer may apply charges for currency conversion. Milcrest Estate will not cover the cost of these charges or accept responsibility for any currency conversion charges. All prices are New Zealand GST (Goods and Services Tax at 15%) inclusive. We accept Visa, Mastercard. We accept payment by direct credit into our bank account. Please note, your credit card information is not disclosed to any other party. Items will be dispatched once full payment has been received. The name that would appear on cardholder / bank statements is Milcrest Estate. Where Milcrest Estate gives the customer the choice to pay be direct credit, if the customer credits money to the incorrect bank account number, and the correct bank account number was provided to the customer by Milcrest Estate, then Milcrest Estate will not accept any responsibility for correcting payments and dispatch of goods will be delayed. The cost of delivery is in addition to the price of the wine and shall be set at $9 per case of up to 12 bottles of wine. Milcrest Estate and the Customer agree that ownership of the Goods shall not pass until the customer has paid the amount owing for the particular Goods. Receipt by Milcrest Estate of any form other than cash shall not be deemed payment until that form of payment has been honoured, cleared or recognised and until then Milcrest Estate ownership or rights in respect of the Goods shall continue. PBT Couriers require you to sign for your order. You will need to give your authority to leave your order with No signature required on your delivery instructions. All orders sent within New Zealand are targeted for delivery between 3-5 working days. If any orders is found to be mis-addressed by Milcrest Estate then Milcrest Estate will be responsible for the re-delivery, replacement or refunding of the item(s). If the customer is found to have given an incorrect or insufficient address, then Milcrest Estate will not refund or resend the product and all responsibility will be borne by the customer. The Customer shall inspect the Goods on delivery and shall within 30 days of delivery (time being of the essence) notify Milcrest Estate of any alleged defect, shortage of quantity, damage or failure to comply with the description. The Customer shall afford Milcrest Estate an opportunity to inspect the Goods with a reasonable time following delivery if the Customer believes the Goods are defective in any way. If the Customer shall fail to comply with these provisions the Goods shall be presumed to be free from any defect or damage. For defective Goods, which Milcrest Estate has agreed in writing that the Customer is entitled to reject, Milcrest Estate’s liability is limited to either (at Milcrest Estate’s discretion) replacing the Goods or repairing the Goods. Returns will only be accepted provided that:
We strongly advise all customers to check goods thoroughly upon delivery. Once your Goods has been returned to us within the above stated time frame, unless otherwise authorised by the Directors of Milcrest Estate, we will begin to process your refund request. Each item will undergo a quality control check and once verified, your refund will be processed in the original payment format at your purchase was made within 30 days of the date of cancellation notice. All undamaged, correctly returned products will be credited to the original purchases credit card or bank account, including GST, but excluding courier charges. You will be notified via email to the address listed on your account when the transaction has taken place. Please note that your bank institution may require additional days to process and post the transaction to your account once they have received the information from Milcrest Estate. Any goods supplied or sold by Milcrest Estate, are sold under the conditions of New Zealand Law
If the Customer is acquiring Goods for the purpose of a trade or business, the Customer acknowledges that the provisions of the Consumer Guarantees Act 1993 do not apply to the supply of Goods by Milcrest Estate to the Customer. Milcrest Estate and 123Online, our web development partner, have worked hard to make this website as user friendly and informative as possible. When viewing the pages of this website, you acknowledge that you have read and accepted the following disclaimer. The information on this website is provided for general information only.
